Welcome to MINDSETOR. These Terms of Use apply to all users of our platform and services. By creating an account or using our services, you agree to these terms.

01 // DEFINITIONS

Definitions

Account: The User's personal profile created to access Mindsetor.

Agreement: The legal agreement between User and MINDSETOR established upon Account creation.

Algorithm: The proprietary MINDSETOR logic used to analyze well-being data and provide automated advice.

MINDSETOR: The sole proprietorship (ZZP) of David Chakrian, registered in Edmond Jasparstraat 48A, 6217HR, Maastricht, Netherlands. Chamber of Commerce (KVK): 77361199.

Specialist: Psychologists or well-being experts engaged by MINDSETOR to provide 1:1 sessions.

User: An employee of a company that has a valid Service Agreement with MINDSETOR.

02 // NATURE OF SERVICE

Nature of Service

2.1

MINDSETOR is a mental well-being platform, not a licensed healthcare provider.

2.2

Our services support general well-being and burnout prevention; they do not diagnose or treat medical conditions.

2.3

Emergency Protocol: MINDSETOR is not for crises. If you have suicidal thoughts or an emergency, immediately contact:

03 // AI TRANSPARENCY

AI Transparency

3.1

The platform uses a proprietary algorithm to provide automated well-being insights.

3.2

Per the EU AI Act, burnout risk detection is an automated process.

3.3

Human-in-the-Loop: Automated insights are informational only. Users may request human review by booking a Specialist session.

04 // PROFESSIONAL STANDARDS

Professional Standards

4.1

All Specialists adhere to their professional codes of conduct (e.g., NIP for psychologists).

4.2

Per Dutch Wkkgz, complaints may be directed to support@mindsetor.com.

05 // ELIGIBILITY

Eligibility

5.1

You must be at least 16 years old.

5.2

Access is provided exclusively to employees of organizations with a MINDSETOR contract.

5.3

Individual data and session notes are never shared with your employer in identifiable format.

06 // RULES OF CONDUCT

Rules of Conduct

6.1

Users must provide accurate information and keep credentials confidential.

6.2

You may not reverse-engineer, scrape, or copy the MINDSETOR platform.

07 // GAMIFICATION & REWARDS

Gamification & Rewards

7.1

MINDSETOR includes gamification elements (points, badges, leaderboards) to encourage engagement.

7.2

From time to time, MINDSETOR or its corporate partners may offer real-world rewards based on leaderboard performance or achievement milestones.

7.3

Apple Inc. is not a sponsor of, or responsible for conducting, any such promotions or contests on the platform.

7.4

No purchase is necessary to participate in leaderboard rankings or earn achievements.

7.5

Rewards are distributed at the sole discretion of MINDSETOR or the Employer and are subject to official contest rules provided at the time of the event.

7.6

Users found manipulating the system (e.g. cheating, automated scripts) will be disqualified from rewards and may face account suspension.

08 // LIABILITY

Liability

8.1

MINDSETOR is not liable for damages except in cases of willful misconduct.

8.2

Liability is limited to €1,000 or fees paid in the last 12 months, whichever is lower.

8.3

MINDSETOR is not liable for indirect or consequential damages.

09 // DATA PROCESSING

Data Processing

9.1

Personal data is processed per our Privacy Policy and the DPA signed with your employer.

10 // GOVERNING LAW

Governing Law

10.1

These terms are governed by Dutch Law.

10.2

Disputes shall be brought before the court in Maastricht, Netherlands.
